Terms of service

These terms govern your use of the Driveino dispatch platform. By signing up or using the service, you agree to be bound by them. Where a defined term is in bold the meaning carries throughout this document.
1. The agreement
This is a contract between Driveino Ltd ("Driveino", "we", "us") and the legal entity that signed up — your company, sole-trader business, or you personally if you signed up as an individual ("you", "the Customer").
By creating an account, you confirm that you have authority to bind that entity to this agreement.
2. What we provide
Driveino is a web and mobile platform for dispatching, tracking, billing, and managing chauffeur and private-hire jobs, drivers, vehicles and customers. The specific features available depend on the plan you select. We may add, remove or change features over time; material reductions to a paid plan are announced at least 14 days in advance.
3. Your account
- You must keep your login credentials confidential. You are responsible for activity under your account.
- Each company user seat is one human. Shared logins are not permitted — you can add seats from your billing page.
- We reserve the right to suspend an account that shows signs of compromise or abusive use until you re-secure it.
4. 7-day free trial
Every new company account starts with a 7-day free trial. During the trial you have full access to the plan you selected. Direct Debit is set up at signup (so it's ready) but no money is collected during the trial. Your first collection lands on day 8.
You can cancel during the trial at any time from your billing page — no money will be taken.
5. Subscription & payment
- Subscriptions are billed monthly by Direct Debit through GoCardless. Card payments are not supported.
- The first month is charged at the end of your trial; subsequent collections are taken on the same calendar day every month (capped at the 28th).
- Bacs typically takes 3 working days to clear after a charge is submitted; the statement reference will read "Driveino".
- Add-ons activated mid-cycle are pro-rated for the days remaining in your current period, then included in your monthly charge from the next billing day.
- You can change plan at any time. Upgrades apply immediately with a pro-rata top-up; downgrades apply on your next billing day.
- Extra company users beyond your plan's included headcount are charged at the per-seat price shown on the plan you're on.
6. Failed payments
If a Direct Debit fails, we'll notify you and retry. Your subscription will move to a past-due state. We won't suspend the service immediately — we'll work with you to resolve the failure. Persistently unresolved past-due accounts may have features restricted after 14 days.
7. Cancelling
- You can cancel any time from your billing page. There's no notice period and no cancellation fee.
- Cancelling stops future Direct Debit collections. You keep access until the end of the current paid period.
- We will not issue refunds for partial months unless required by law or where we agreed to one in writing.
- Under the Direct Debit Guarantee, your bank will refund any payment taken in error and you can cancel the mandate at any time through your bank.
8. Acceptable use
You may not use the platform to:
- Send unsolicited messaging (spam) or anything that violates the WhatsApp Business Policy / your SMS provider's terms.
- Process personal data unlawfully or without an appropriate legal basis.
- Reverse-engineer, copy or resell the platform.
- Attempt to bypass security controls or rate limits.
- Use the platform to support activity that is illegal in the UK or in any jurisdiction your business operates in.
9. Your data & your customers
- You retain ownership of all customer, driver, job and billing data you upload to the platform.
- You can export your data at any time. On account closure, you have 30 days to retrieve it before deletion.
- Driveino is a data processor for data you process about your drivers and end customers. Our processing of that data is governed by our Privacy policy and (on request) a written Data Processing Agreement.
- You are responsible for having a lawful basis to collect and process the personal data you upload, and for giving your customers and drivers any required notices.
10. Service availability
We target 99.5% uptime measured monthly. Scheduled maintenance is announced in advance and usually performed outside UK working hours. We don't offer a credit-based SLA on standard plans; if there's a serious outage we'll communicate proactively.
11. Liability
- The platform is provided "as is". To the maximum extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.
- Driveino is not liable for indirect, consequential, special or punitive damages, or for loss of profits, revenue, goodwill, or anticipated savings.
- Our aggregate liability for any 12-month period is capped at the fees you paid us in that period.
- Nothing in this clause limits liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be excluded by UK law.
12. Indemnity
You agree to indemnify Driveino against third-party claims arising out of your unlawful use of the platform, your breach of these terms, or your processing of personal data in violation of applicable law.
13. Suspension & termination
We may suspend or terminate your account immediately if you breach these terms in a way that risks legal liability to us or harm to other users, or if your subscription is overdue by more than 30 days after a written reminder. You may terminate at any time as set out in clause 7.
14. Changes to these terms
If we make material changes we'll email account holders and post a notice in the app at least 14 days before they take effect. Continued use after that date constitutes acceptance.
15. Governing law & disputes
These terms are governed by the laws of England and Wales. Any dispute that can't be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales.
